Copyright and takedown

Spell Movies does not accept uploads from the public. Every title on the service arrives through a distribution agreement with a studio, a distributor or a rights holder, and what we may show, where, and for how long, comes from that agreement.

That does not make a mistake impossible. A licence can be misdescribed, a territory can be wrong, and a rights holder can disagree with the party who licensed to us. If you think we are showing something we should not be, tell us and we will act.

Send notices of claimed copyright infringement to the agent Spell Movies has designated to receive them.

The email address is the fastest route and is monitored. A notice sent to any other address at Spell Movies may not reach the agent.

United States law sets out what a notice has to include for us to act on it. A notice missing any of these may not be effective, and we will usually come back to you rather than ignore it. Please include all six.

• A physical or electronic signature of the copyright owner, or of a person authorised to act for them.
• Identification of the copyrighted work you say has been infringed. If several works at one location are covered, a representative list of them.
• Identification of the material you say is infringing, with enough detail for us to find it. A link to the title page on Spell Movies is the most useful thing you can give us.
• Your contact details, including an address, a telephone number and an email address.
• A statement that you believe in good faith that the use complained of is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorised to act for them.

Please be accurate. Anyone who knowingly makes a material misrepresentation that material is infringing can be liable for the costs and damages that follow, including ours and those of the person whose material was removed.

• We acknowledge the notice to the address you gave us.
• Where the notice is effective, we remove or disable access to the material promptly, which for us usually means pulling the title from the catalogue in the affected territories.
• We tell the licensor who supplied the title, and we tell them who sent the notice.
• We record the notice, what we did about it, and when.

If material you supplied was removed and you believe that was a mistake or a misidentification, you may send a counter notification to the same agent. It must include your signature, identification of the material and where it was before it was removed, a statement under penalty of perjury that you believe in good faith it was removed as a result of mistake or misidentification, your name, address and telephone number, and your consent to the jurisdiction of the federal court for the district where you live, or where we are located if you are outside the United States, and your agreement to accept service from the person who sent the original notice.

We pass a valid counter notification to whoever sent the original notice. Unless they tell us they have gone to court, we may restore the material in ten to fourteen business days.

We terminate the accounts of repeat infringers. Because we do not accept uploads from the public, this most often means an account being used to record or redistribute what it is streaming, which we also treat as a breach of our terms of service.

For a trade mark complaint, a right of publicity complaint, or a complaint about how a person is portrayed, write to the legal address on our terms of service page rather than to the copyright agent, and describe the problem in the same amount of detail. We will route it to the right place.
