Terms of service

This document is published in English, and the English text is the one that governs. A translated version will be added once it has been reviewed locally.
These are the rules for using Spell Movies. They cover who may hold an account, what you may do with the films, what you pay, and what happens if something goes wrong.
The agreement
Spell Movies is operated by Spell Movies, LLC. By creating an account or watching anything on the service you agree to these terms. If you do not agree, do not use the service.

You must be at least thirteen years old to hold an account. We ask for your date of birth once when you set the account up, and an account whose stated date of birth is below thirteen is closed immediately.
If you are under the age of majority where you live, you may only hold an account with the involvement of a parent or guardian, who is responsible for it and for anything charged to it.
A child in your household watches through a child's profile on your account. You choose the content ceiling for that profile and you set the code that protects it. Keep the code to yourself. Anyone who has it can change what a child can see.
Your account
Your account is signed in with Spell ID, which is the single account used across our properties. Keep your sign in details private. You are responsible for what happens on your account, and for the people in your household who use it.
An account is for one household. Your plan sets how many devices may stream at the same time, and we enforce that limit. Sharing an account outside your household is not permitted.
You can sign out any device, or every device, from your account settings. If you think someone else has your details, do that first and then tell us.
What you may do with the films
We license the films and series on Spell Movies from the studios and rights holders who own them. We are passing you a limited right to watch, not selling you a copy.
For as long as your subscription or your rental is active, you may stream the titles available to you for your own personal, non commercial use, within your household, in the country where they are available to you.
You may not copy, record, download outside the app's own download feature, redistribute, publicly perform, broadcast, resell or make a derivative of anything on the service. You may not remove or interfere with the protections on the video, the keys, the signed delivery credentials, or any restriction on where a title may be watched.
What is available differs by country, and it changes. A title can leave the service when the licence behind it ends. We will not always be able to give notice, and a title leaving is not a breach of this agreement. If a title you have rented becomes unavailable before your rental window ends, you get a refund of that rental.
Subtitles and dubbing
Much of our catalogue reaches you in a language it was not made in. Our subtitles and dubs are produced with machine translation and machine speech, adapted for the culture rather than translated word for word, and confirmed by a person before publication. Voice casting is always confirmed by a person and is never automatic.
We say this plainly because we think you should know how the words you are reading and the voices you are hearing were made. Where a licensor supplied their own subtitle or dub, we use theirs.
Plans, rentals and payment
Some of the catalogue is free to watch. The rest needs a subscription, or a rental of a single title.
A subscription renews automatically at the end of each period at the price shown when you subscribed, until you cancel. We will tell you before the price changes, and you can cancel before the change takes effect.
You can cancel at any time. Cancelling stops the next renewal. You keep access until the end of the period you have already paid for, and we do not refund a part period.
A rental gives you a window to start the title and a shorter window to finish it once you have started. Both are shown before you pay. A rental is not refundable once you have started watching it.
If you subscribed through an app store, that store takes the payment and its own rules on billing and refunds apply alongside these terms. Manage or cancel that subscription in the store.
Nothing in this section limits any right you have under consumer law where you live, including any right to cancel that the law gives you.
How you may use the service
Do not do any of the following.
- Get around, or try to get around, the content protection, the geographic limits, the stream limit or the child protections.
- Use an automated tool to scrape, harvest or bulk download from the service.
- Probe or attack our systems, or interfere with anyone else's use of the service.
- Use someone else's account, or let someone outside your household use yours.
- Send anything abusive, harassing, unlawful or infringing through a shared viewing feature.
- Present the service, or anything on it, as your own.
If you use a shared viewing feature, what you send is your responsibility, and you must not send anything you do not have the right to send.
Copyright complaints
If you believe something on Spell Movies infringes your copyright, our copyright page explains how to send a notice, what it must contain, and who to send it to. We remove infringing material and we terminate the accounts of repeat infringers.
Copyright and takedownSuspension and termination
You can close your account at any time from your account settings. Closing it deletes your data as described in the privacy policy.
We may suspend or close an account that breaks these terms, that we reasonably believe is being used fraudulently, or that we are required to close by law. Where it is fair to do so we will warn you first and give you a chance to put it right. If we close a paid account for a reason that is not your fault, we refund the unused part of what you paid.
Changes to the service and to these terms
The service changes. Features arrive, features go, and the catalogue turns over constantly. We may change the service, and we will not make a change that materially reduces what a paid plan gives you during a period you have already paid for.
When we change these terms in a way that matters we publish the new version here with a new version number and effective date and tell you before it takes effect. If you do not accept the change you may close your account, and we will refund the unused part of the current period.
What we do and do not promise
We work hard to keep the service running and to make the streams good, but we cannot promise it will never be interrupted, never have a fault, or work on every device and every connection. The service is provided as it is.
We are responsible for loss we cause you that was a foreseeable result of us breaking this agreement or failing to use reasonable care. We are not responsible for loss that was not foreseeable, for business losses, or for anything outside our reasonable control. Where the law allows a limit, our total responsibility to you is limited to what you paid us in the twelve months before the event.
Nothing in this agreement excludes responsibility that the law does not allow us to exclude, including for death or personal injury caused by our negligence and for fraud. If you are a consumer, you keep every right consumer law gives you, and nothing here takes any of them away.
Governing law and disputes
This section is reserved. Spell Movies will state here which law governs this agreement and how a dispute is resolved, before these terms take effect. Until then, nothing in this agreement affects the right of a consumer to bring a claim in the courts of the country where they live, under the law of that country.
Whatever this section ends up saying, please write to us first. Almost everything is quicker to fix that way.
The rest
If a court finds part of this agreement unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer this agreement to anyone else. We may transfer it if the business is sold, and your rights are unaffected if we do.
This agreement, together with the privacy policy and the cookie policy, is the whole agreement between us about the service.
